The New York District Attorney is the region's elected attorney for New York County (Manhattan), New York. The office is responsible for prosecuting violations of New York state law. (The federal law offenses in Manhattan are prosecuted by the US Attorney for the Southern District of New York.) The district attorney today is Cyrus Vance, Jr.

District prosecutors are legally allowed to delegate small crime prosecution or infringement. The prosecutor does not normally handle court cases calling the New York City Court, and DA Manhattan has a memorandum of understanding with the NYPD that allows the NYPD Legal Bureau to selectively prosecute them.

In a legislative act on February 12, 1796, the State of New York was divided into seven districts, each with the Assistant Attorney General, except New York County where Josiah Og August Hoffman was prosecuted personally until 1801.

From 1801 to 1813, New York County was part of the First District, which included New York, Kings, Queens, Richmond and Suffolk districts. At the time, Queens included the current Nassau County and Westchester including the Bronx. In 1813, Westchester County was distributed to the new district with the districts of Rockland and Putnam, and in 1815, New York District became the Twelfth District - the only one at the time was an area. In 1818, every county in the state became his own district.

From 1874 to 1895, New York County included the Western Bronx, and from 1895 to 1913 including all that now is the Bronx County, which governs the same area as the current Borough Bronx. On January 1, 1914, the Bronx became a separate area with its own district attorney.

Until 1822, the district prosecutor was appointed by the Council of Appointment, and held the title "during the pleasure of the Council", meaning that no term of office was determined. Under the terms of the New York State Constitution of 1821, D.A. was appointed to a three-year tenure by the County Court, and under the terms of the 1846 Constitution, the office became elective by popular vote. This term is three years, beginning on January 1 and ending on 31 December. In the case of a job vacancy, a district attorney acts appointed by the General Assembly until the New York Governor fills the void with temporary appointment until elections are held for the remainder of the term.

The 1896 Consolidated Charter extended the term of John R. Fellows, who was elected in 1893 to a period of three years (1894-1896) per year. Since the election of the City of 1897, the term D.A. has coincided with the Mayor's term and has been for four years. In the case of a job vacancy, the governor may still make a temporary appointment until a special election is held for the remainder of the term.
