The United States District Court for the Western District of Missouri (in the case excerpt, WD Mo. ) is a federal district court covering 66 counties in the western part of the State of Missouri. The court is based at Charles Evans Whittaker Courthouse in Kansas City.

The current United States lawyer is Timothy A. Garrison since 5 January 2018.

Histori

Missouri was accepted as a state on 10 August 1821, and the United States Congress established the United States District Court for the District of Missouri on March 16, 1822. The district was assigned to the Eighth Circuit on March 3, 1837. The congress was divided into Eastern and Western Districts on March 3, 1857 and has since only made minor adjustments to the boundaries of the subdivision. This division was driven by a substantial increase in the number of admiralty cases arising from traffic on the Mississippi River, which had followed Congressional action passed in 1845 and upheld by the United States Supreme Court in 1851, extending the federal admiral jurisdiction to inland waters. These disputes involve "affreightment contracts, crashes, marine wages, and other causes of admiralty jurisdiction", and the litigants who appear in St. Petersburg. Louis felt uncomfortable to travel to Jefferson City for their cases to stand trial.

When the District of Missouri was divided again, Robert William Wells was the only judge serving the District of Missouri. Wells then moved to serve only the Western District.

Jurisdiction

The district is divided into five divisions: West (Kansas City), Central (Jefferson City), Southern (Springfield), Southwestern (Joplin), and St. Joseph (St. Joseph). There is a division clerk's office in Jefferson City and Springfield next to the main office in Kansas City. New cases and defenses in the District Court may be filed to the clerk's office in Kansas City, Jefferson City, and Springfield; Filing of the Bankruptcy Court, however, is only accepted at the Kansas City clerk's office. United States Court of Appeals for the Eighth Circuit in Missouri at St. Louis has jurisdiction over appealed decisions from the Western District of Missouri (except for patent claims and claims against the US government under the Tucker Act, which appeals to the Federal Circuit).

The five divisions of each court include the following countries:

The Western divisions include Bates, Carroll, Cass, Clay, Henry, Jackson, Johnson, Lafayette, Ray, St. Clair, and Saline areas.

Divisi Tengah meliputi Benton, Boone, Callaway, Camden, Cole, Cooper, Hickory, Howard, Miller, Moniteau, Morgan, Osage, dan Pettis County.

Divisi Selatan meliputi Cedar, Christian, Dade, Dallas, Douglas, Greene, Howell, Laclede, Oregon, Ozark, Polk, Pulaski, Taney, Texas, Webster, dan Wright County.

Divisi St. Joseph meliputi Andrew, Atchison, Buchanan, Caldwell, Clinton, Daviess, DeKalb, Gentry, Grundy, Harrison, Holt, Livingston, Mercer, Nodaway, Platte, Putnam, Sullivan, dan Worth counties.

The Southwest Division includes Barry, Barton, Jasper, Lawrence, McDonald, Newton, Stone, and Vernon County.

Chief Justice

The Chief Judge has administrative responsibility for their district court. Unlike the Supreme Court, in which one justice is specifically nominated for head, the office of the chief judge revolves among district court judges. To be a chief, a judge must have been active in court for at least a year, under 65, and has never served as a chief judge. Vacancies are filled by the highest judges in seniority among eligible judges. The presiding judge shall be valid for a period of seven years or until the age of 70, whichever occurs first. Age restrictions are waived if no court member will qualify for that position.

When the office was founded in 1948, the chief judge was the longest serving judge who did not choose to retire on what has been known since 1958 as a senior status or refused to serve as a chief judge. After 6 August 1959, the judge could not become or remain head after the age of 70 years. Current rules have been in operation since October 1, 1982.
